DELIVERY INFORMATION

We offer free delivery to all major South African city centres for all orders including delivery of orders paid for using discount coupons or vouchers.

A courier surcharge may also be levied depending on the delivery address outside the borders of South Africa and is within the courier’s discretion.

We aim to process your order as quickly as possible. Delivery is made within five to seven working days of the order being processed (Standard delivery, and depending on the payment method used). Native Décor only ships orders via courier from Monday to Friday, during office hours and does not operate on public holidays. We are not liable for any damages, losses, charges or expenses arising from errors made by the couriers.

All packages can be tracked on the courier company’s website by making use of the tracking reference that we provide you with once your order has been dispatched. When completing your details for delivery, it is advisable to enter your work address or address that is normally occupied during office hours.

In the event that there is an unexpected delay we will communicate this to you via phone or email.

We cannot be held responsible for an incorrect address being entered while ordering on our website. If you complete your order and then notice that the address details are incorrect, please contact us immediately : Info@nativedecor.co.za

RETURNS POLICY

1. CANCELLATION BY CUSTOMER (NON-FAULTY PRODUCT)

1.1 You are entitled to cancel any sale concluded on the Site within Fourteen (14) days of receipt of the goods and to obtain a refund for the sale amount only. You may also cancel a sale where delivery is delayed beyond the stipulated delivery date/time frame (or where none is specified, beyond 14 days from the order date).

1.2 No cancellation fee shall apply.

1.3 Initial delivery fee and cash handling fees, where applicable, are not refundable. Native Décor will only cover the fee of the return of a faulty product.

2. FAULTY PRODUCTS

2.1 We warrant that the product will be delivered undamaged in the quantities ordered; and

2.2 Before delivery, we may make minor adjustments to material, colour, weight, measurements, design and other features to the extent that they are reasonable.

2.3 We try very hard to deliver Products in excellent condition. However, if you tell us that the Product is faulty, you may return the product to us using the same courier company for which we will cover the courier fee for the return trip only. Delivery fees and cash handling fees for the initial delivery, where applicable, are not refundable.

2.4 In order to provide you with any remedies for a faulty product, we may need your assistance and prompt provision of certain information regarding the Product, including:

a) Specification with reasonable detail the way in which the product is damaged or defective; and
b) Provision of a delivery note number and such other information as we reasonably require.

2.5 If you would like Native Décor to replace or provide a refund for the product where it did conform to the applicable terms and conditions and we find that the Product has:
a) Been misused, abused or subjected to neglect, improper or inadequate care, carelessness, damage or abnormal conditions;or
b) Been involved in any accident or damage caused by an incorrect attempt at modification or repair; or
c) Been dealt with or used contrary to Native Décor’s instructions for the product; or
d) Deteriorated through normal wear and tear, after delivery by Native Décor. We may at our discretion decide not to replace or refund you for the product and/or we may require you to pay all reasonable carriage costs and servicing costs at Native Décor’s current standard fees and costs and charge this to your credit or cheque card, or the payment details that you provided to us when you made your order. We shall not be liable to you for any losses, liabilities, costs, damages, charges or expenses delivery by Native Décor as a result.

TERMS & CONDITIONS

  1. Introduction:

1.1 We are Native Décor (Pty) Ltd with registration number 2015/2453/87.

1.2 These Terms and Conditions govern the supply by us of any Products ordered by you on the Site. By agreeing to order a Product, you agree to be legally bound by these Terms and Conditions.

1.3 In these Terms and Conditions:

1.3.1 Definitions:

  1. a) “Account” means the account that you will need to register for on the Site if you would like to submit an Order on the Site;
  2. b) “Acknowledgement” means our acknowledgement of your Order by email;
  3. c) “Business Day” means a day which is neither (i) a Saturday or Sunday, nor (ii) a public holiday anywhere in South Africa;
  4. d) “Confirmation of Order” means our email to you, in which we accept your Order;
  5. e) “Customer” means individual who places an Order on the Site;

f)”Liability” has the meaning given to it in clause 4.1(a) of these Terms and Conditions;

  1. g) “Order” means the order submitted by you to the Site to purchase a Product from us;
  2. h) “You” means the Customer who places an Order;
  3. i) “We” means Native Décor (Pty) Ltd, as described above;
  4. j) References to “clauses” are to the clauses of these Terms and Conditions;

1.3.2 Headings are for ease of reference only and shall not affect the interpretation or construction of the Terms and Conditions;

1.3.3 Words imparting the singular shall include the plural and vice versa;

1.3.4 Words imparting a gender shall include every gender and references to persons shall include an individual, company, corporation, firm or partnership;

1.3.5 References to “includes” or “including” or like words or expressions shall mean without limitation.

 

  1. Cancellation

2.1 We reserve the right, for purpose of suspected fraud, to refuse to accept or process payment on any order, and/or to cancel any sale concluded between you and Native Décor, in whole or in part, if the product is not available for any reason. We will notify you if this is the case and return any payment that you have made, and accept no liability which may arise as a result of such refusal to process any order/sale.

2.2 We will refund any money received from you via EFT for which we would require you to furnish us with your banking details.

 

  1. Privacy Policy

3.1 Native Décor will never spam you or give your personal data to anyone else. You can read our privacy policy detailed below. Rest assured, we make it our priority to keep your private information safe with us.

3.2 We take our customers privacy seriously and we will only collect and use your personal information as outlined below. We shall take all reasonable steps to protect your personal information. For the purpose of this clause, “personal information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA).

 

  1. Limitation of Liability

4.1 This clause 4 prevails over all other clauses and sets forth our entire Liability, and your sole and exclusive remedies, for:

  1. a) The performance, non-performance, purported performance or delay in performance of these Terms and Conditions or a Contract or the Site (or anypart of it or them); or
  2. b) Otherwise in relation to these Terms and Conditions or the entering into or performance of these Terms and Conditions.

4.2 We will at all times do our utmost best to ensure that all information displayed on the Site and in any communications from Native Décor is accurate, however, should any inaccurate information be published by Native Décor (i.e.. incorrect Product description or price), despite our best efforts to ensure accuracy, We shall not be liable for any direct, indirect, incidental or consequential loss or damage suffered by you as a result of the in accurate information.

  1. Personal information collected

5.1 Native Décor does not sell, share or trade customer’s personal information collected online with any other parties. Personal information collected online will only be disclosed within our corporate group for internal use only.

6.1 When you create an account the personal information we collect may include your:

  • Delivery Address
  • Email Address
  • Telephone Number
  • Mobile Number
  • Date of Birth
  • Gender
  • ID number / passport number; and
  • Non-personal browsing habits and click patterns

6.2 The personal information we collect from you will be used in some or all of the following ways:

  • To deliver the products you have purchased from Native Décor
  • To update you on the delivery of the product and for customer support purposes
  • To provide you with relevant product information

6.3 When you register as a user on Native Décor’s website, we will also use your personal information to send you marketing and/or promotional materials from time to time should you agree to accept these communications. You can unsubscribe from marketing information at any time by using the unsubscribe function within the electronic marketing material.

8.1 Native Décor ensures that all information collected will be safely and securely stored.

8.2 We protect your personal information by:

  • Restricting access to personal information
  • Maintaining technology products to prevent unauthorised computer access
  • Securely destroying your personal information when it’s no longer needed for our record retention purposes

8.3 Native Décor uses 128 – bit SSL (securesockets layer) encryption technology with exyended validation when processing your financial details. 128-bit SSL encryption is approximated to take at least one trillion years to break, and is the industry standard.

9.1 We will not share your information with any other organisations.

9.2 In exceptional circumstances Native Décor maybe required to disclose personal information, such as when there are grounds to believe that the disclosure is necessary to prevent a threat to life or health, or for law enforcement purposes.

9.3 Native Décor is committed to complying with the Promotion of Access to Information Act 2 of 2000 and its principles.

10.1 When you visit Native Décor, our company servers will automatically record information that your browser sends whenever you visit a website. This data may include:

  • Web page you were visiting before you came to our site
  • The pages with Native Décor you visit
  • The time spent on those pages, items and information searched for on our site, access times and dates, and other statistics.

10.2 This information is collected for analysis and evaluation in order to help us improve our site and the services and products we provide. This data will not be used in association with any other personal information.

13.1 Save for Native Décor being liable to you

  1. a) Under the Consumer Protection Act 68 of 2008 in relation to any products sold by Native Décor to you via the site; and
  2. b) Under sections 43(5) and 43(6) of the electronic communications and Transactions Act in relation to Native Décor’s payment systems not being sufficiently secure.

13.2 Native Décor shall not be liable for any damage, loss or liability of whatsoever nature arising from the use or inability to use this Site or the services or content provided from and through this Site. Furthermore, Native Décor makes no representations or warranties, implied or otherwise, that, amongst others, the content and technology available from this Site are free from errors or omissions or that the service will be 100% uninterrupted and error free. You are encouraged to report any possible malfunctions and errors to info@nativedecor.co.za.

Although the products sold via the Site may be under warranty, the Site itself is supplied on an “as is” basis and has not been compiled or supplied to meet your individual requirements. It is your sole responsibility to satisfy yourself prior to accepting these Terms and Conditions that the service available from and through this Site will meet your individual requirements and be compatible with your hardware and/or software.
